These Terms of Sale and Service (“Terms”) govern your access to and use of siapure.com and any purchase of products offered under the SIAPURE brand.

SIAPURE is operated by Rémi Flous, a French sole proprietor (entreprise individuelle) trading under the commercial name Explore Ailleurs.

Throughout these Terms, “SIAPURE,” “we,” “us,” and “our” refer to Rémi Flous – Explore Ailleurs. “You” and “customer” refer to the person accessing the website or purchasing our products.

By using our website or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order.

Our products are intended primarily for personal and household use. Commercial resale is not permitted without our prior written authorization.

We reserve the right to refuse or cancel an order where the sale, shipment, or use of a product would violate applicable law or regulatory requirements.

2. Products

We make reasonable efforts to display and describe our products accurately. Product colors, finishes, packaging, and minor design details may vary slightly from photographs depending on manufacturing batches, screen settings, or other factors.

Product availability is not guaranteed. We may modify or discontinue products at any time.

A product being displayed on the website does not guarantee that it can legally be sold or shipped to every jurisdiction.

3. Product Use and Performance

SIAPURE products must be installed, maintained, and used in accordance with the instructions supplied with the product and any instructions made available on our website.

Performance may vary depending on water quality, water pressure, temperature, cartridge condition, frequency of use, and local water characteristics.

Unless expressly stated and supported by applicable testing, SIAPURE does not represent that its shower filtration products:

• remove all contaminants or substances from water;

• soften water or remove all hardness minerals;

• make non-potable water safe to drink;

• disinfect water or eliminate all microorganisms;

• diagnose, treat, cure, or prevent any medical condition.

Information concerning skin, hair, shower water, or wellness is provided for general informational purposes and is not medical advice.

Individual experiences and results may vary.

4. Orders

When you place an order, you are making an offer to purchase the products in your cart.

We may accept or decline an order at our discretion, including because of:

• product availability;

• suspected fraud or unauthorized payment;

• incorrect pricing or product information;

• shipping restrictions;

• regulatory restrictions;

• technical errors;

• unusually large or suspicious orders.

An automated order confirmation does not necessarily constitute final acceptance of the order.

If we cancel an order after payment has been collected, we will refund the amount charged for the cancelled items.

5. Pricing and Currency

Prices on our U.S. storefront are displayed in U.S. dollars (USD) unless otherwise stated.

We may change prices at any time. A price change will not affect an order already accepted, except where there is an obvious pricing or technical error.

Applicable sales taxes, where legally required, may be calculated and displayed at checkout.

Promotional offers, discount codes, and special pricing may be subject to separate conditions and expiration dates.

Unless expressly stated otherwise, promotional offers cannot be combined.

6. Payment

Payment must be authorized at checkout.

Available payment methods may include credit and debit cards, Shop Pay, Apple Pay, Google Pay, PayPal, or other payment methods displayed at checkout.

Payments are processed through Shopify and/or third-party payment providers. We do not directly store your complete payment card information.

If a payment is declined, reversed, flagged as potentially fraudulent, or otherwise cannot be completed, we may suspend or cancel the relevant order.

7. Shipping and Delivery

We offer free standard shipping to eligible U.S. delivery addresses unless otherwise stated at checkout.

Our current estimated delivery timeframe is generally:

7–14 business days

unless another timeframe is clearly displayed before purchase.

Delivery dates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Orders may be fulfilled by international manufacturing or fulfillment partners and may be dispatched from facilities located outside the United States.

You are responsible for providing a complete and accurate shipping address.

If an order is returned or requires reshipment because of an incorrect or incomplete address provided by the customer, reasonable additional shipping charges may apply.

Once your order has been dispatched, tracking information will be provided when available.

Shipping delays

We aim to fulfill orders within the timeframe communicated to you.

If we learn that we cannot ship your order within the applicable promised timeframe, we may contact you to offer a revised shipment timeframe and the option to accept the delay or cancel the affected order for a refund, as required by applicable law.

Import duties

This paragraph should only remain on the website if DDP shipping has been confirmed with our fulfillment provider.

For shipments sent on a Delivered Duty Paid (“DDP”) basis, SIAPURE pays applicable customs duties and import charges associated with importing the shipment, and customers should not be required to pay additional customs duties upon delivery.

Any taxes properly charged directly to the customer at checkout are separate from import duties.

8. Lost, Delayed or Missing Packages

If your tracking information shows an unusual delay, please contact us at contact.siapure@gmail.com.

If a shipment is lost in transit, we will work with the carrier or fulfillment provider and, where appropriate, arrange a replacement or refund.

If tracking indicates that a parcel has been delivered but you cannot locate it, please first check the delivery location, household members, neighbors where appropriate, and the carrier's tracking information, then contact us so that we can investigate.

Remedies for lost or missing packages will depend on the circumstances, carrier investigation, and applicable law.

9. 30-Day Money-Back Guarantee

The SIAPURE shower head is covered by our 30-Day Money-Back Guarantee.

You have 30 days from the date your order is delivered to request a return.

We allow you to reasonably install and test the shower head during this period.

To qualify for a return, the product must not have been:

• deliberately damaged;

• materially altered or modified;

• excessively damaged through misuse or improper installation;

• returned with essential components missing.

Reasonable use necessary to evaluate the shower head does not automatically make it ineligible for return.

Do not return products to our registered business address unless we specifically instruct you to do so.

We will provide the appropriate return instructions and return address after your request has been approved.

10. Return Shipping Costs

If you return an eligible product because you simply changed your mind or no longer want it, return shipping costs are your responsibility.

If the product we supplied is defective, damaged on arrival, or materially different from what you ordered, SIAPURE will cover reasonable return shipping costs or provide another appropriate solution.

No restocking fee is charged for an eligible return.

11. Replacement Filter Returns

For hygiene and product-integrity reasons, opened or used replacement filter cartridges cannot be returned because of a change of mind.

Unopened replacement filters may be returned within the applicable 30-day return period if otherwise eligible.

This exclusion does not apply where replacement filters are defective, damaged, incorrect, or where applicable law requires another remedy.

Use of the filter supplied with a SIAPURE shower head for the purpose of reasonably testing the shower head does not by itself invalidate the shower head's 30-Day Money-Back Guarantee.

12. Refunds

Once an eligible return has been received and inspected, we will notify you of the outcome.

Approved refunds will be issued to the original payment method within 10 business days after we receive and inspect the returned product.

The time required for the refund to appear in your account after we issue it depends on your bank or payment provider.

Because standard outbound shipping is currently offered free of charge, there is normally no original standard shipping fee to refund.

Any rights you may have under mandatory applicable consumer law remain unaffected.

13. Damaged, Defective or Incorrect Products

Please inspect your order when you receive it.

If a product arrives damaged, defective, incomplete, or different from the product ordered, contact contact.siapure@gmail.com as soon as reasonably possible.

We may request photographs, videos, packaging information, or other reasonable evidence to help us identify the issue.

Depending on the circumstances, we may offer:

• replacement of the affected product or component;

• reshipment;

• repair where appropriate;

• partial refund where agreed with you;

• full refund.

Nothing in this section limits any remedy that cannot legally be excluded.

14. Exchanges

We do not guarantee direct product exchanges.

Where appropriate, we may ask you to return an eligible product for a refund and place a new order for the replacement item.

For defective or incorrect products, we may instead arrange a replacement directly.

15. Order Changes and Cancellations

If you need to change or cancel an order, contact us as soon as possible at contact.siapure@gmail.com.

We cannot guarantee changes or cancellation once an order has entered processing or has been shipped.

This does not limit cancellation or refund rights arising from a shipping delay or other rights required by applicable law.

16. Filter Subscription

Where offered, customers may purchase eligible SIAPURE replacement filters through an automatically renewing subscription.

The subscription currently provides 20% off eligible refill filters and renews every three months.

The recurring price, billing frequency, products included, and other material subscription terms will be displayed before you subscribe.

By intentionally selecting the subscription option and completing checkout, you authorize us to charge the applicable recurring subscription amount to your selected payment method every three months until cancelled.

Subscriptions automatically renew unless cancelled before the next applicable charge.

You may cancel your subscription at any time through the online subscription-management functionality made available through Shopify or our subscription platform.

Cancellation prevents future renewals but does not automatically reverse a subscription order that has already been charged and entered processing.

If we materially change the recurring price or subscription terms, we will provide any advance notice required by applicable law.

Subscription cancellation does not affect rights relating to defective, damaged, incorrect, or otherwise legally nonconforming products.

17. Promotions and Discounts

Promotional codes, subscription discounts, limited-time offers, bundles, and other promotions may have their own conditions.

We may end or modify a promotion at any time before an eligible purchase is completed.

We may refuse a discount or cancel an order where a promotion has been used fraudulently, contrary to its stated conditions, or because of an obvious technical error.

Unless otherwise stated, discounts have no cash value and cannot be redeemed for cash.

18. Intellectual Property

The website and its content, including branding, logos, product photography, graphics, videos, copy, designs, layout, and other materials, are owned by or licensed to SIAPURE or its respective rights holders and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial purposes.

You may not reproduce, distribute, republish, sell, commercially exploit, or create unauthorized derivative works from protected SIAPURE content without prior permission.

19. Reviews and Customer Content

If you voluntarily submit a product review, photograph, video, testimonial, comment, or other content to SIAPURE, you confirm that your contribution reflects your genuine experience and does not knowingly contain false, unlawful, defamatory, or infringing content.

Where you give us permission to use such content, we may use it for the purposes described when permission is obtained, subject to applicable law and any specific agreement with you.

We do not require customers to provide exclusively positive reviews.

20. Third-Party Services

Our website may use or link to services operated by third parties, including Shopify, payment processors, social-media platforms, analytics providers, fulfillment services, and other technology providers.

Their services may be subject to their own terms and privacy practices.

SIAPURE is not responsible for independent third-party websites that we do not operate.

21. Privacy

Our collection and use of personal information are described in our Privacy Policy.

Our website may use technologies provided by Shopify and other service providers for essential website operation, analytics, advertising, personalization, fraud prevention, and marketing, subject to applicable privacy law and your available choices.

22. Prohibited Use

You may not use the website to:

• commit or facilitate unlawful activity;

• submit fraudulent orders or payment information;

• interfere with the security or operation of the website;

• introduce malicious software;

• scrape or exploit the website in violation of applicable law;

• infringe the intellectual property or legal rights of others;

• impersonate another person;

• attempt to obtain unauthorized access to systems or customer information.

We may restrict access where reasonably necessary to protect customers, our business, or the website.

23. Disclaimer of Warranties

Except for the express 30-Day Money-Back Guarantee described above and any rights that cannot legally be excluded, products and website services are provided subject to applicable law without additional voluntary warranties unless expressly stated.

We do not guarantee that the website will always be uninterrupted, error-free, or available.

Nothing in these Terms excludes any warranty, guarantee, remedy, or consumer right that cannot legally be excluded or limited.

24. Limitation of Liability

To the fullest extent permitted by applicable law, SIAPURE will not be liable for indirect, incidental, special, punitive, or consequential losses arising solely from use of the website or products where such liability may lawfully be excluded.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law.

In particular, these Terms do not seek to exclude liability for fraud, intentional misconduct, or any other liability that applicable law makes non-excludable.

Some U.S. states do not permit certain limitations or exclusions of liability, so some of the above limitations may not apply to you.

25. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses directly resulting from your intentional unlawful misuse of the website or your material violation of these Terms.

Nothing in this section requires a consumer to indemnify SIAPURE for SIAPURE's own negligence, unlawful conduct, or obligations that cannot legally be transferred to the consumer.

26. Governing Law and Disputes

These Terms are governed by the laws of France, without regard to conflict-of-law principles, except to the extent that mandatory consumer-protection laws applicable to you provide rights that cannot lawfully be waived by contract.

Nothing in these Terms is intended to deprive a U.S. consumer of mandatory protections that apply under federal law or the laws of the consumer's applicable U.S. jurisdiction.

These Terms do not impose a mandatory arbitration requirement or class-action waiver.

27. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our services, products, technology, or legal requirements.

The version published on the website will display its effective date.

Changes will not retroactively alter the essential terms of an order already completed unless required by law or agreed with you.

For automatically renewing subscriptions, material changes will be communicated where required by applicable law.

28. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

29. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive the right to enforce it later.

30. Entire Agreement

These Terms, together with our applicable:

form the agreement governing your use of the website and purchases from SIAPURE.

If a specific product offer or promotion expressly provides terms that differ from these general Terms, the more specific disclosed terms will apply to that offer to the extent of the inconsistency.
